TERMS OF SERVICE

These Terms of Service (“Terms”) govern the provision of services by Sealing St Louis (doing business as Sealing St Louis , “we,” “us,” or “our”) to you (“Client,” “you,” or “your”) for concrete cleaning, sealing, pressure washing, soft washing, and related exterior surface services (collectively, the “Services”).

By requesting a quote, scheduling Services, making a deposit/payment, or otherwise engaging our Services (including via phone, email, text, our website at www.sealingstlouis.com, or in person), you agree to be bound by these Terms. If you do not agree, do not engage our Services.

1. Scope of Services

We will perform the specific Services described in your quote, estimate, proposal, invoice, or work order (the “Work Order”), which becomes part of this agreement upon acceptance (verbal, written, payment of deposit, or commencement of work). Services typically include high-pressure or soft washing to remove dirt, mold, mildew, stains, and contaminants, followed by application of sealers or protectants to concrete, pavers, driveways, patios, walkways, or similar surfaces.

We reserve the right to adjust the scope if unforeseen conditions are discovered (e.g., existing sealers, severe damage, or hidden issues requiring additional preparation), with your prior approval for any additional charges.

2. Client Responsibilities and Preparation

To enable safe and effective performance of the Services, you agree to:

Provide clear, unobstructed access to the work area and an operable water source (spigot) with adequate pressure.

Close and secure all windows, doors, and vents near the work area to prevent water intrusion.

Remove or protect vehicles, plants, outdoor furniture, decorations, pets, and any fragile items from the work area.

Inform us in advance of any known issues (e.g., loose pavers, cracks, prior sealers, ongoing construction, or sensitive landscaping).

Ensure the property is safe and free of hazards (e.g., no active pets or children in the area during work).

Failure to prepare adequately may result in rescheduling at your expense or additional charges.

3. Scheduling, Rescheduling, and Cancellation

Appointments are scheduled based on availability. We will provide a confirmed date/time. You must provide at least 24 hours' notice for cancellations or rescheduling; otherwise, a cancellation/rescheduling fee (up to 50% of the quoted price) may apply. We reserve the right to cancel or reschedule due to weather, unsafe conditions, or unforeseen circumstances, with no penalty to us.

4. Payment Terms

Quotes/Estimates are valid for 30 days unless stated otherwise.

A deposit (typically 30-50% of the total) is required to secure scheduling and is non-refundable once work begins or materials are ordered.

The balance is due upon completion of Services unless other arrangements are made in writing.

Accepted payment methods: [list methods, e.g., cash, check, credit card, electronic transfer].

Late payments incur a fee of [e.g., 1.5% per month or $25 minimum].

NSF/returned checks incur a $45 fee.

All prices exclude applicable sales tax unless stated.

5. Results, Limitations, and No Guarantees on Appearance or Longevity

Concrete and exterior surfaces vary widely due to age, original pour quality, prior treatments, weathering, and environmental factors. Cleaning may reveal underlying imperfections (e.g., etching, pitting, color variations, efflorescence, or uneven curing) previously masked by dirt or stains.

Sealing provides water repellency, stain resistance, and protection against some damage, but results depend on surface condition, application conditions, maintenance, and exposure. We do not guarantee:

Uniform appearance or elimination of all stains/imperfections.

Prevention of all future cracking, spalling, or damage from freeze-thaw cycles, heavy use, de-icing salts, or improper maintenance.

Longevity beyond typical industry expectations (e.g., 1-2 years depending on sealer type and conditions).

We use industry-standard products and methods but cannot control post-service variables.

6. Warranty and Limitations of Liability

We warrant our workmanship for [e.g., 1 year] from completion against defects in application (e.g., peeling sealer due to improper prep, if notified promptly). This warranty is limited to re-application of affected areas at our discretion and does not cover normal wear, misuse, or external factors.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE AMOUNT PAID FOR THE SPECIFIC SERVICES IN QUESTION. We are not liable for indirect, consequential, incidental, or punitive damages, including property damage, water intrusion, personal injury, loss of use, or business interruption.

We carry general liability insurance but are not responsible for pre-existing damage, improper installation (e.g., loose siding, unsealed windows/doors, wood rot), or water intrusion due to inadequate seals/cracks.

7. Indemnification

You agree to indemnify and hold us harmless from claims arising from your failure to disclose hazards, inadequate preparation, or your negligence.

8. Termination

Either party may terminate for material breach with written notice and a reasonable cure period. We may suspend or terminate Services if payment is overdue or conditions are unsafe.

9. Force Majeure

We are not liable for delays or failure due to weather, acts of God, labor disputes, or events beyond our reasonable control.

10. Governing Law and Dispute Resolution

These Terms are governed by Missouri law. Any disputes shall be resolved first through good-faith negotiation, then mediation if needed, and finally in the courts of St. Louis County, Missouri. You waive any right to jury trial to the extent permitted.

11. Entire Agreement; Amendments

These Terms, together with the Work Order/quote, constitute the entire agreement. Amendments must be in writing and signed by both parties.

12. Severability

If any provision is invalid, the remainder remains enforceable.
